The life and career of Ruth Bader Ginsburg is worth several movies, and in fact there was already a documentary about her out this year. But for her narrative biography, it took family to truly capture the heart of Ginsburg the person as well as the lawyer and ultimate Supreme Court Justice.

Daniel Stiepleman is Ginsburg’s nephew and On the Basis of Sex is his first produced screenplay. It focuses on Ginsbyrg’s early life and marriage to Martin Ginsburg. After graduating Harvard, in one of the first classes that allowed women, the Ginsburgs try the Moritz case to set a precedent for discrimination on the basis of sex. Charles Moritz (Chris Mulkey) was denied a tax write-off as a caretaker because the law assumed only women would be caretakers.

Stiepleman went to film school and earned a Nicholl Fellowship from the Academy, but decided to join the Peace Corps at 22 to find his worldview. He met his wife in the Corps and became a high school English teacher where he encouraged his students to think about more interesting questions. That provided him the lightbulb moment to write this script about his aunt and uncle.

Now Stiepleman is attached to three more screenplays, including Debriefing the President based on John Nixon’s book about interrogating Saddam Hussein, the Usula le Guin adaptation Planet of Exile and the Sharon Draper Adaptation Out Of My Mind. Stiepleman spoke with /Film about On the Basis of Sex which opens on Christmas Day and expands to more theaters in January.

There’s a scene in almost every teen TV drama where the teacher describes the theme of the episode that will come to pass over the next 45 minutes. The majority of On the Basis of Sex is like that.

The Ruth Bader Ginsburg biopic stars Felicity Jones as the trailblazing lawyer who later becomes one of our foremost Supreme Court justices and only the second female Supreme Court justice in history. But On the Basis of Sex focuses on Ginsburg’s first landmark case that launched her career as the premiere advocate against gender discrimination. Which would be fine if that were actually the case. Instead, the first half-hour of the film plays like a checklist of Ginsburg’s early life, peppered with winking moments to the time period’s retrograde perspective on women. Ruth enters Harvard and shoots to the top of her class: Check. Ruth balances raising a child and caring for a cancer-stricken husband (Armie Hammer) with her studies: Check. Ruth literally does everything her husband Martin does, backwards and in heels, and still gets denied a career as a lawyer: Check.

All throughout her struggles, Ruth maintains her noble disposition and perfectly coiffed hair, simply raising her chin at the injustices with the implied knowledge that she is destined for greater things. For the first half-hour of the film, On the Basis of Sex is too caught up in its label as an important film, breathlessly recounting the life story of an icon of female empowerment while a soaring score briskly carries the story along and fills in its gaps. But if you skip that first half-hour, you may find a powerful and affecting film.

On the Basis of Sex is the story of Ruth Bader Ginsberg. Not the Supreme Court Justice we know now, but the Ruth Bader Ginsburg who was one of the first female students at Harvard Law School, who began her legal career fighting to overturn a case of gender discrimination.

Felicity Jones plays Ruth and the case in question is the Moritz case. Charles Moritz was denied a caretaker tax write-off because it was assumed caretakers could only be women. Ruth’s husband Martin Ginsburg actually pointed her to the case because he knew she was interested in finding ways to fight sexism.
