Tracking the Piracy of 2008 Oscar-Nominated Films

Ever since the advent of DVD and bittorrent technology, it’s been inevitable: Studios that send out screeners to Academy members inevitably see those films end up pirated and downloaded on torrent sites. But just how extensive is the problem, and how has its pervasiveness changed over time?

In his post, “Pirating the 2009 Oscars,” Andy Baio from Waxy.org has put together a stunning and comprehensive analysis. Baio has been monitoring Oscar films and their rates of piracy for the past 6 years, most recently adding the 26 nominees for this year’s upcoming Oscar ceremony, which makes his list encompass a solid 211 films in total.   • Over the past few years, the vast majority of Oscar-nominated films have typically been available online in a high-quality format come Oscar time. This year doesn’t change that trend at all. Out of the 26 films that received Oscar nominations, 24 of them are available online in DVD quality (the only ones excluded are Rachel Getting Married and Changeling, the latter of which is available as a low quality telecine transfer).
  • Academy members received screeners for at least 20 out of the 26 nominated films.
  • The average time from the time high-quality screeners are received by Academy members to the time they are leaked online is 6 days.
  • Compared to past years, Oscar-nominated movies this year actually took longer to show up online in any format (such as a cam) after their initial theatrical release, with the median time clocking in at 11 days. Baio attributes this to either a crackdown on cameras in theaters, or less online demand for Oscar nominated films in general this year.

  • I think it was more because most Oscar caliber films were first in limited release, obviously limiting cam'ing opportunities. Once 'screener season' started, they were out within days of each other and had multiple thousands of downloads.

  • Are you talking about Los Angeles? Because it has been playing at Landmark Theater for weeks! Not to mention Arclight! LA has wonderful theaters big and small, you can find a lot of films, you just have to look a bit.

    Yeah Claremont was playing it as well as Pasadena's Laemle's or whatever you call it, as well as it playing in Brea, besides just in LA. But I downloaded it too after watching it in the theatre twice.

    Not really, there's no standards on those junk pay sites. Good Torrent sites will get you a 1gb file in less than an hour. And it works 99% of the time.

    hmmm....i wonder why oscar movies are pirated.....maybe because studios choose to release horrible movies in wide release and look at audiences like their dumb little kids that can handle a "in depth" movie....we need a statistic on how much seven pounds has been pirated in comparison please.

  • its the only way I can see most oscar nominated movies, otherwise I would have to drive an hour plus for the smaller films. Sooo until they offer me a more convenient way to pay for them without an hour plus drive I will download them.

    i agree. I've never understood the "select theater" stuff. all the good movies are select theaters, while the shit movies play at the theaters near me. i have to cleveland just to see a good movie. and i don't have a car, so screw that.

    Well, people who frequent sites like this aren't your typical American movie goer. Most just see whatever is out and aren't followers of film news or rumors. I do wish that movies like "The Wrestler" and "Slumdog Millionaire" were afforded wide releases because they're so awesome.

    I'm in Northwest Florida, and we still haven't gotten The Wrestler in theatres, but everybody and their mother here has downloaded it. January really is the worst month for movie-lovers in smaller markets. All these acclaimed, award-winning movies aren't released here, but the films that nobody wants to see can be seen every hour, on the hour.
  • I agree fully with brett and John S. .. good films are hard to find and are barely shown in theaters yet crappy film like disaster movie get released all over and have like 20 screenings daily in one theater. seriously at times I wonder who the fock is in control. most people like to be treated like adults and not like kids who still laugh at fart jokes.

  • It does seem like pirated movies are on the rise as of late. I have seen a few pirated movies that are high quality. If they really wanted to stop pirates from putting movies onto the internet, they should find some way to track the actual footage back to the person who uploaded it. I'm sure there are better techniques to stopping this.

    the people that "pirate" movies are much more internet and computer savvy than those who try to catch them. they're not looking for any form of compensation and they make it so everyone can watch these movies, leave them alone.
  • I'm not complaining about the fact that alot of people get to watch movies for free, it's just that if they really had a problem with it, they could find a way to stop it. Even if that means hiring people that re just as computer savvy as the people that "pirate" the movies.
  • muffin7: Like I said on my site, I took the stats straight out of the release NFO databases, namely Nforce, Predb, and VCD Quality. The "Changeling" release was definitely *not* a DVD screener... Odds are it was a mislabeled VHS screener or telecine. If you notice any other problems with the data, drop me a line. My info's on my site.
  • I just to add one more thing. It's rare for a torrent sites that gets scene releases to not get cams within 24 hours of release. Sometimes they will pop up within just a few hours of the release or even well before (depending on how many screenings were held). They are terrible quality though. Unwatchable IMO.
  • I have pirated only one movie in my entire life. I reeeealy wanted to see the Assassination of Richard Nixon last week but could not find the DVD, thus I still can feel morally superior to pirates because i do in fact own the thing.

  • Scale back the marketing campaigns for utter shit like 'Paul Blart' and focus that into putting better films in the eyes of hungry movie watchers.

    When you're trying to see what's available on the Internet, an easy and efficient way is to just go to torrentz.com (or another torrent search engine) and search for what you're interested in. Another easy way is to search the edonkey network. Don't bother with NFO databases.

    For Changeling there are at least the following DVD Screeners available:

    DVDScr DivX LTT
    DVDScr DivX LTT v2
    DVDscr Dragon25

    I've checked two of them and they look and sound good - they're definitely NOT Telecine or Cam versions. The look like DVD rips.

    As for Rachel Getting Married, there is indeed nothing available yet.

  • cib3k: The problem with searching eDonkey, the Pirate Bay, or the various torrent meta-search engines is that you end up with unreliable, fake, and mislabeled results, just like the so-called Changeling DVD screener. For research purposes, the NFO databases provide a reliable and vetted date from very knowledgeable people. The P2P networks are a total mess.

    The Changeling releases you mentioned are all transcodes of the same video, almost certainly a telesync or a badly-done telecine, albeit one with very high-quality audio. The video quality is about that of a high-quality cam or, at best, a VHS screener.
  • If you don't want people to illegally download the Oscar bait maybe the studios should arrange it so people can actually see the movies at a reasonable price.

    I had to travel over an hour and a half to see Slumdog because the theatre near me would never even touch a Danny Boyle film. Frost/Nixon has been playing in just one "select" theatre in my area (an hour's drive) but what the hell. Saw it there. Truth be told, I saw The Wrestler by downloading it off demonoid as well as Milk. Those won't be coming anytime to a local theatre near me... Yeah, this is fucking stupid. Open these films up wide like you do Mall Cop or Disaster Movie. Great movies will generate great word of mouth and people will show up at the boxoffice. Hell, I would rather see a movie in a crowded theatre any day than watch them on my computer. That's the truth... When your product is not easily accessible people will find other means to get it or just ignore it... Come to think of it, may be Hollywood should just smash the whole torrent piracy deal altogether and release ALL new films on the internet as pay per view like ITUNES. Think of it. If you can't make it to the theatre or have a big family just download it legally. Example--Go to the Paramount site on the opening day of J.J.'s STAR TREK get your digital copy for say ten or fifteen bucks...

    Yeah but those places are far off from where I live. The closest theater I got is one in Crenshaw. People get shot in the parking lot.
  • Gotcha, I go to Hollywood only for Arclight (rarely for Grauman's Chinese) and besides that I stay firmly on the Westside of LA. I prefer to not go to a theater that is known for shootings in the parking lot. It is safe in Marina del Rey and Santa Monica where I hang out.

    If you look for some older films, you should check out the Aero theater in Santa Monica, excellent programming there.

  • So I bet you go see movies by the Magic Johnson Center? Howard Hughes Center isn't bad, but the tickets are pricey and the audiences are mostly teenagers that text too much.

    I've heard of the Howard Hughes Center before but I've never really checked it out.

  • I've read most of these comments and I do agree with them. It is hard to watch a movie when it's not even around any of the places we live. If they really wanted us to watch their movie, they would put it somewhere closer.

    We as movie goers, hear nothing bu the best of these films and are dying to watch it and see what all the fuss is about. We want to see it right away and if it isn't available right away, we find other means to watch these good movies.

    Yes, the whole stepped-release model is retarded. It's an Oscar movie yet they are afraid to release it wide, but have to release it in LA and NY so it can qualify for Awards. Then they slowly roll it out. People who like movies WANT to see these. These executives need to pull their heads out and realize that BUZZ has already been established. I would have paid to see the WRESTLER, but it wasn't playing near me and wasn't going to open for about 3 weeks when the screener was released.

    And gheez, do the Shorts ever get distro'd? ANd sometimes the Foreign films don't see the light of DVD for quite some time and then they get that fscing premium pricing .. $29.99 for a DVD? Meh.
  • Many Australian release dates are set after the awards, to take advantage of any received. So I'm left with no choice but to download and watch before the ceremony, to ensure I've seen as many as possible and enable me to follow the show better.

    When a film is good enough, I back it up by seeing it properly in the cinema as well.
  • Distribution as a whole is in a sad, sad state in these United States.
  • They send out all those DVD's to guild members and expect that nobody is going to pirate them. I wouldn't feel bad about watching pirated screeners, because why should guild members get to have these DVDs and the rest of the world is a criminal for having them. Many people who receive them don't even vote, they just watch them and do nothing. It's not like those people are contributing anything to the makers of the film, just the annual guild fees. If directors are going for awards then I think they would just be happy that people are watching the flick. The studios are the only people who should be concerned about this, and if they want it to stop they should just hand out passes to guild members for movies that are up for nomination instead of sending out DVD's.
    And I don't know where he got his info or what torrent sites he goes to, but Changeling has been available (dvd screener) for the past few months on my torrent site. I've still not watched it though.
