Watchmen: Warner Bros says “Settlement Unlikely”

Not that we didn’t already expect this but, an attorney for 20th Century Fox told AP that the studio is planning to continue to seek an injunction to prevent the release of Watchmen. U.S. District Court Judge Gary Feess ruled last week that Warner Bros had infringed on 20th Century Fox’s rights to develop and distribute a movie adaptation of Alan Moore’s Watchmen graphic novel.

A Warner Bros.’ attorney told the AP that hhe believes “a trial is necessary and a settlement unlikely.” As of right now, a trial is still scheduled for January 20th to decide the remaining issues. If Warners and Fox can’t reach a settlement before that date, it is likely that the Judge will grant the injunction which will at very least push back the release date of the comic book movie adaptation until a settlement is agreed upon.

    *sigh*......
  • Lono
Somewhere Alan Moore is laughing...and possibly tripping...
  • indeed.
  • While I'm not as....eloquent....as StarBlazer above, I do agree that the fact that its Fox blocking this movie just makes the whole thing that much more hard to swallow. Fox hasn't been able to get out of it's own way lately and has done nothing but develop flop after flop. Now that another studio actually succeeded in doing what they never could, produce a respected movie version of Watchmen, they are the proverbial spoiled kid in the corner crying foul. The fact that this movie is sure to be a blockbuster if it is good is the only reason this is going to court. I am certain there are many properties each year that are made under another studio after years of failing somewhere else. This one just happens to be one of the most popular movies heading into 2009.

Sadly I'm beginning to believe that this film will never be seen. The Judge already ruled in favor of Fox. And knowing Fox, and judging from their actions so far, its very likely they will bury the film and the public will never get to see it.

And if they do somehow release the film Fox will cut it up and make it an hour and half long film that everyone hates. This is a very sad moment for fans of Watchmen and movie fans in general.
  • I'm sure if Fox kills the film that it will still leak all over the web.
  • ScanCase
But is that a good thing? Watchmen is too important to live solely in the back alleyways of the internet. Granted we haven't seen the film yet and don't even know if its actually good but shouldn't it at least be seen by the masses and not by just a handful of people.

My love for Watchmen is making my heart break right now. For once people would go into a superhero movie and learn what it means to live in our society today, and there is a very good chance that will not happen.

I try and recommend the book to anyone who will listen but its hard to get people who don't normally read comic's or graphic novels to even pick it up. Isn't it better to have an accessible film that anyone can get into.

If the fate of Watchmen is to be pirated across the internet then what does that mean about the message the film is trying to point out. Is the truth so detrimental to society that it can only exist in the slums of our world. For all our sakes I don't want that to happen.
  • Hey I don't like it either, but if this is the only way for it to be seen...
  • Stoned One
Dude, I can't help but think you are being a tad melodramatic. It is a graphic novel that was turned into a film. Populist art like this rarely has the effect that you wish it should. Crying over this is stupid. It will eventually be made for everyone to see. Don't get your superhero pants in a bunch.
  • The Hick
i recieved watchmen for christmas, never reading a single comic book before in my life,(do love batman and other superheroes however) and i was amazed by it, calling it just a graphic novel does unjustice to it, it is a fine piece of work and i too reccomend it to anyone , even if you dont read comics. The movie trailer looked so good i had to read it, i will be devastated if this movie doesnt release, i really want to see this on screen adaptation
  • Stoned One
I am happy to hear that you are reading. Reading is good for the mind and can be much better than a movie because you are actually using your imagination! But if you are going to be devastated if a movie isn't released, that again is you being melodramatic. How does calling it a graphic novel disgrace the story? That is the name for the format, how can it be an injustice to the format?
  • raptorz44
I hate to say it, but as much as I want the movie to be released, Fox does have every right to sue. If they truly do still have the rights, regardless of how long they have had it for, they should have a right to distribute it.
  • I don't understand why Fox wouldn't want to release the movie. Is it too good for their studio to release? Wouldn't anythink made on the film be profit for them?!?
  • Endorian
Read the article one more time. Fox WANT to release the movie. WB is the one saying "No Settlement". In any settlement Fox will gain some of the profit (they own the rights), but Warner just doesn't want to share...
  • It's almost like this movie wasn't meant to be.
  • i'm with you, too good to be true
  • Somebody in Warner's legal department messed up, big time.
  • YUH! Someone is getting the sack over this one!
  • Brian from OR
There is alot of blame to go around. Fox should have said something when Paramount was trying to make the film a few years ago. And Warner Bros legal department should have really double checked everything to see if everything was set to go before production started. To me this lawsuit comes down to greed. Fox saw a chance to make alot of money by using the legal system at the last min. They must think that WB can afford it after the success of The Dark Knight. But like I said WB and producer Lawrence Gordan really should have double checked to see if everything was legal before going forward.
  • Fox couldn't sue until there was a product to sue against. Simple.
  • the hick
im sure a film in production counts as a product to sue against, thislast minute stuff is bullshit
  • Actually, Warner's is bullshit for going ahead when they didn't have the rights. Fox are completely within their rights - be more mad at WB for leading you down the garden path.
  • Just leak it as a torrent and let us see it.
  • So I guess no one else is good enough to see it? Just us graphic novel and movie snobs?
  • yes...cause it takes a genius to figure out how to use bittorrent.
  • graham7x
why hasnt fox said anything until now
hasnt a movie been in development since the 80's with about every studio
  • kheas
The horror of our legal system and the need for people to sue just because we can. First Fox fracks Firefly, (among other greats) and now the smeg-heads are about to do the same to Watchmen. Lets all get together and boycott FOX. Yeah, they have the right to sue, but sometime having the right to do something isnt reason enough to exercise those rights. FOX, just settle and enjoy the income this movie will make, cause its gonna be a hit!
  • what is the big deal about Firefly? i watched it, sure fine, whatever, it's a TV show, get over it
  • kheas
I'm just using Firefly as an example of what they have don to great shows/films in the past.
But if you must know...IF FOX had given it half a chance Firefly could have been the next great SciFi. It had all of the elements and a wonderful cast. But FOX in its infinite wisdom had to 1, show the pilot last,2. play almost all of the out of order,3. cancel it before anyone had a chance to see it. Why cant FOX actually make something good? Because apparently the suits at FOX studios don't have a true sence of their audiences!
  • I know the whole story, I watched the show and just didn't get the fuss, Joss Whedon isn't the second coming of Christ.
  • You're right, he may not be the second coming of Christ, but he's sure as hell might be John the Baptist. Firefly was awesome. Buffy was awesome. And if you didn't see Dr. Horrible, you missed the best web show of the year.
  • kheas
Joss has a vision of what good entertainment can be. Now, if he could only find a network that wont screw him over time and again. I have to say that I am really excited about Dollhouse, unfortunately its also on FOX . The man's good, but he sure is a glutton for punishment!
  • +10 internets for using the term Smeg-head!
  • the old man
Yea Smeg-head is good but not nearly as accurate as felchers. WB may have made a mistake and maybe recalcitrant over it, but why does the beneficiary have to be Fox? My faith in Karma is shaken.. Perhaps the bad will is the beginning of the end of the reign of Rupert. That would re-balance the universe for sure. Make that penguin felchers. Hey if your going ultimate, why not Para ultimate?
  • Mr. Michaelson
Look guys, I agree the movie looks pretty cool. Very cool. But let's put on our adult hats and look at the situation; Warner Brothers KNEW it didn't have all the rights secured and said "Ah whatevs, let's just make the flick anyway" and got called out on their bullshit. Of COURSE Fox waited until the prime moment to sue, who wouldn't? This is the way the movie... hell—BUSINESS in general works. It's not shitty, or spiteful, it's just business. And Zack's company got caught up in a mess they kinda made. It's a shame for Mr. Snyder, who obviously cares for the material, a shame for the project, and a shame for a stupid, shortsighted movie studio... but don't blame Fox. they're just making it where they can, just like WB would.

And stop whining like six-year-olds who aren't getting desert. You just had the Dark Knight, take it easy.
  • Neil
    well said
  • jhgh
I wanna see something new after seeing dark knight for 10 bajillion times....its still not fair :(....
  • kheas
lets be honest. Warner would not have pursued this project if their Lawyers hadn't sniffed it out for problems. Either FOX had this issue very well hidden or WB needs some new legal teams. Either way, FOX just needs to settle and be happy. Just pay them and be done! This movie will recoup the loss!
  • the hick
im sure watever fox settles for will make them more money than the hack job of a movie they would of made haha thank god WB made it
  • Palmer
While Fox may have the right to sue Warner Bros. over this whole issue, The fact that Rupert Murdoch and his band of cronies (Though they probably don't know what Watchmen is) wants to prevent the release of the movies is a stupid movie. I mean the amount of negative backlash that would follow may screw them over in future geek demographic endeavors. And that's if a lot of Fox haters band together.
  • Mr. Michaelson
Actually, it's more about money... not 'spiting' or 'preventing' the movie's release. it WILL release—C'mon, there's money to be made (it's gonna be FOX's money too). So if you are gonna hate, hate on capitalism. Fox saw what a hit this is gonna be and said 'Dude, we CAN GET SOME OF THIS MONEY.' WB can blame only itself, they should have worked this out before the had a such tasty treat on their hands.
  • This is terrible news. I hope they reach an agreement and bring this movie out soon. I bet WB gives this to the internet if they can't release it when they want, well that's what I would like to see.
  • Joe
Agree with Dan...as much as everyone will hate Fox for this...this is all to blame on a big screw up by Warner Brothers. Their legal team clearly didn't have their ducks in a row.
  • starscream9289
I think we can all agree that FOX SUCKS FUCKING COCK
THEY'RE JUST A BUNCH OF WHINY LITTLE BITCHES WHO CAN'T GET A GOOD MOVIE OUT IN THEATERS AND THAT'S WHY THEY WANT TO SCREW UP WATCHMEN AND GET CREDIT FOR SOMETHING THEY HAD NOTHING TO DO WITH!! THE ONLY CRAP THEY CAN DO IS FUCK UP STUFF LIKE DRAGONBALL OR X-MEN!! WHY CAN'T THEY JUST GO BANKRUPT ALREADY!?!?!?!?! GOD!!!
  • Erm, which studio just spent millions making a film they had no rights to release? Fuck me, you'd do the same thing if you were Fox! ESPECIALLY after a year like they've had! WB DO NOT OWN THE RIGHTS. They're idiots for going ahead in the first place. If you're gonna have a sooky cry, aim it at WB for leading you on.
  • Andrew
What ^^^^ he said. Even a first year film student knows to get your fucking clearances. Some heads need to roll at WB.
  • You guys do understand that WB owns the rights to ALL DC comics, which includes Watchmen, right? The problem is that they procured these rights AFTER Fox got Watchmen, which is why Fox is winning. The fact that Fox did all this 20+ years ago and didn't publicize it also doesn't help. I'm not sure what role DC plays in this but I'm guessing WB isn't happy that, in buying all the rights to DC comics, they didn't also get Watchmen.

The legal confusion is much more understandable than what you guys are making it out to be.
  • Andrew
The fact that it's easily understood is the problem: This is a nooby mistake that a MAJOR studio made. Fox is acting like a bag of dicks to be sure, but WB is just as much to blame if not more for this particular snafu.
  • Balls. Are Fox really that desperate for money? Surely Marley & Me will get them something back.
