The Executive Committee of the Academy of Motion Pictures music branch has ruled that the score for The Dark Knight is disqualified because five names were listed as composers on the music cue sheet. What? Apparently this is a common practice done to ensure that the entire music team is financially rewarded. ASCAP and BMI use the names listed on the cue sheet to distribute royalties to composers.

The names listed include Hans Zimmer and James Newton Howard and three other individuals — music editor Alex Gibson, ambient music designer Mel Wesson and composer Lorne Balfe. Variety reports that Gibson, Wesson and Balfe signed an affidavit stating that the score was primarily the work of Zimmer and Howard. But the committee also had documentation claiming that somewhere between 30% and 40% of the score was not authored by Zimmer and Howard. Batman Begins was also disqualified for similar reasons.

For about a month I was listening to The Dark Knight score on repeat. “Why So Serious” never fails to get me pumped up. It’s really a shame that the music is disqualified for the reasons given. I’m sure there might be a lot more to it, and the rules are there to protect the artists involved, but it seems to me that this is a case where the artists involved are being punished for not fitting into the cookie cutter mold.

The Dark Knight Soundtrack is still available for $12.99 on Amazon, but Warner Bros music is also releasing a two-CD special edition (now available for preorder for $45.49 on Amazon), which includes four bonus remix tracks and an 40 page hardbound book.

    I have yet another reason to not watch any more Academy awards...hard to watch something that rubs you the wrong way year after year...Munich or Brokeback should have won in 2005, The Fountain should have been at least nominated for best art direction/music/direction, and George Clooney should have won best actor in 2007. I'm sick of this BS.
  • So the producer's guild (and studios) are against paying writers internet royalties... the Academy is against honoring hard work... and Big Bird gets a star on the Walk of Fame before Clint Eastwood. Hollywood's got its head up its ass.

    Anyone remember Ang Lee's "Lust/Caution"? Rejected by the Academy as Taiwan's Foreign Picture entry because "not enough Taiwanese worked on the movie." Almost sounds like a joke... "How many Taiwanese does it take to make a movie? More than it does to screw in a light bulb."

    You make some acceptable oppositions to what the Academy awarded, but to suggest in any way that George Clooney was better than Daniel Day-Lewis just invalidates your whole post. Go crawl into a hole and die.


    The problem I have with this category is that it is "Best Original Score" NOT "Best Composer." The award should go to the film with the best score, no matter how many individuals worked on it.

    Pretty sad. The Zimmer/Newton-Howard score is amazing for its choices and creativity. The cue that Zimmer developed for the Joker is emotionally rivetting and rivals the famous work that Williams did in his cues for the shark in Jaws.

    I also listened to the score contiuously for a long time and talked myself into attending a third viewing of the film just to focus on the work being done by the score. It really sounded beautiful in the Imax theaters.

    Not surprised, I saw it coming. It's a rule of theirs, and Warner Bros should of learned the first time. As for Johnny Greenwood's, he used stuff he made back in 2001 for another movie. How can he win original soundtrack when his soundtrack wasn't completely original? He was disqualified within reason, so was the Dark Knight. Doesn't make it any less of an amazing soundtrack.

    The Academy sucks, plain and simple. I want to see my favorite people in this industry get recognized. But when it means having them bow down to stupid rules like this.

  • I call shenanigans on this as well. By far one of the best soundtracks of the year, and likewise There Will Be Blood was cheated out of even a nomination. Of course they used music from it during the ceremony, but couldn't bear to give it a nomination.

    I'll disagree with one point from the article. "Why So Serious" isn't a pulse racer. It's "Like a Dog Chasing Cars". That's an awesome track, and it wasn't even in the movie!!!

    Would you prefer that those 1-2 men not credit the 3-4 people that also helped on the score. With Hans, he would give "Additional Music by" credit to the one who changes a string line in a 1 minute cue.

    This is common practice by the Academy. Nothing new. However, they change their rules every now and then.

    For instance, Howard Shore wasn't nominated for his second LotR-Score because it contained music from the first film. By the time, Return of the King was nominated they had changed that rule for no obvious reason (except the very obvious: Why denie him the chance to get an Oscar that year, when the film took away a total of 11 statues?).

    But someone explain the "Babel Incedent" then. They nominated Babel, which contained just a couple of original music pieces but mostly stuff that was written before the movie was made. In the end Babel actually won best muscic score... just ridiculous.

    I don't think TDK would have been a worthy contestant for "Best Score". It's not bad, but surely it isn't great. However in 2000 they nominated Gladiator and there was not difference in the making of that score (they even left out Lisa Gerrad when mentioning the nominees).

    Oh... but as far as I know, Hans Zimmer used to have a paragraph in his contracts that actually forbid the studios to get him nominated because he didn't like the excitement of the whole process. Go figure...

    The reason for disqualifiying the Dark Knight score may not be understandable. But the score itself is simply not that good. Zimmer and Howard work better when they work alone. I.m.o. EVERY score by J.N.H. is far more interesting that the generic action movie score he and Zimmer composed for T.D.K..

    That notwithstanding, the academy decions are generally ridiculous. I mean, RETURN OF THE KING won best picture. C'mon.

WOW! original! they ripped it off from the scene in "The Shining" where Jack Nicholson was trying to get the bat from his wife!     Actually it's not. The only time when its similar is when they use the theme found in the opening track for Batman Begins. Everything else is new.
