PineappleGate 2008 Update: The NY Daily News confronted James Franco about the growing t-shirt controversy and he continues to deny it, reiterating that David Gordon Green “came up with his own design” and calling PineappleGate “ridiculous.” At this time, no one involved with the film has contacted WOWCH for free popcorn.

For the sake of trivia amongst future generations of stoned college students, here we go. A brutal controversy is flaring up over the origins of the “Shark-kitten” t-shirt worn by actor James Franco for the entire duration of the hit pot comedy Pineapple Express, and in the posters and trailers et al. The popular and extremely DIY Brooklyn t-shirt partymeisters, WOWCH, claim that the movie ripped off their design from 2005. Their design, which is done in the signature WTF style of the company, is seen below. (And yes, I own a couple of their t-shirts, and believe the filmmakers committed this naughty sin).

In a recent interview, Franco attributed the design to the brain of director David Gordon Green. WOWCH claims the design was just flipped, darkened and the color of the cat changed from white to yellow. Somebody call Judge Judy. Now, this matter might seem silly, but if you recall the Richard Pryor t-shirt worn by Jonah Hill in Superbad, and that t-shirt’s ensuing popularity—undoubtedly a hipster/geek staple for years to come—WOWCH should have gotten a hat tip in the shape of a Jacuzzi limo. Instead of asking for a bazillion dollars, the classy dudes will forever refer to the film as Plagarist Express [sic] and demand: “GIVE US FREE PASSES AND POPCORN. AND MAYBE A LARGE SODA THAT WE WILL PUT 2 STRAWS IN.” They also want to remind viewers that the cute kitten is, in fact, dead, and not being carried marsupial-like by the Great White.

Update: In the name of capitalism, Cool Stuff, and Pet Semetary, WOWCH’s uber-famous kitten has now returned from the dead. Now available in “trendy American Apparel gym class heather gray for all the haters.”

    James Franco Interview: There is a I think it’s supposed to be a Great White shark although it’s a bit shaded so it’s black. THERE'S A KITTEN IN IT THAT LOOKS SERENE. It’s almost like it’s sleeping. I think the shark is not eating it, but carrying it to safety. The kitten was left out in the ocean and this shark decided to put it in it’s mouth and carry it to shore.

  • I think it's different enough to not be a total rip-off. Also, I don't recall anyone wearing a Richard Pryor t-shirt anywhere last year, and I was on a major college campus.

    Maybe it's just me, but I think the one in the movie is drastically better looking than the original. It just seems more appealing to have it all worn and gray.

    Why the hissy fit? It's not like Green and the entire Apatow posse came out and claimed sole creative responsibility for the t-shirt. It was probably just Franco assuming something that was very incorrect. End of story.
    As for the alterations, again, see above. If Franco was wearing the original, it would have looked retarded, as the original just isn't very good looking to begin with.
    In all honesty, WOWCH probably saw the shirt and after realizing where it came from, they decided to go to town and publicize the shit out of their site in their pseudo-anger.

    I'm certain if any of you designed a shirt and saw someone as big as the Apatow group taking credit for your work (accidentally or not) you wouldn't hesitate to get a little free advertising out of the deal.

    Even if Franco's version is much more stylish, the shirt is I obviously taken from that website and they're
    lucky that the company isn't taking legal action.
  • how is it way better? Its the exact same shirt except flipped sides and a different color. Pretty sure you can order the WOWCH one in a grey color and wear it for 4 weeks w/o washing it, VOILA you have the PE shirt.

    Also, that's the same exact t-shirt design. If not it's "almost" exact. The only difference is that's it's flipped and on a gray shirt that looks like it hasn't been washed in months.

    It is also possible that Green had seen the shirt once and forgotten about it, then came up with the idea for the P.E. shirt. It happens. WOWCH says on their website that there were only about 500 shirts made total, so it's not like they're pervasive. I just think they see an opportunity to get some free press for their site.

    And yeah, the grey version in the movie looks way better than their version. I wonder who if anyone will sell a version like the one in the movie?

    Maxt at WOWCH has emailed Slashfilm to say....

    "yeah we talked to some copyright lawyers----- they said the problem is that the movie doesnt seem to be directly profiting from the image so a lawsuit could just turn into a case of intellectual property which is hard to work with. they said it would be risky and expensive to try anything legally except for maybe an angry letter. So I figured why get bummed out in court when I can have fun barnstormin' on the internet."

    Did T-Shirt hell complain when their His-Panic At The Disco! shirt was picked up by the band? No, they came up with another, better idea. Besides, if WOWCH really cared about their design, the shirt would still be in print (imo, a company has no right to complain about piracy/duplication of OOP items, since they can't even make any more money off it at that point).

    As is, they're just taking advantage of Pineapple's high-profile (I'd never heard of WOWCH before this post, anyway) and Hunter fell for it hook, line, and sinker. Does he or a friend own the company? He's awfully defensive in the comments.

    Finally, $25 for a shirt is RIDICULOUS. Especially since you know that'll fall apart after one wash cycle.

    Folks your missing the point the guys at WOWCH came up with the idea of the design, spent time and money putting it on a t-shirt, therefore it's their intellectual property. This douche shades it, reverses it and screen prints it and calls it his own. Ask David Gordon Green if he minds people selling pirate versions of his movie?

  • It is lame for them not to give credit to the t-shirt. No doubt most defenders of PE are those who are never likely to create anything that anyone would want to rip off. But complaining about it online is a great way to draw free attention to the company.

    I love people who remember a soundbyte from a story and think they know the whole thing so they perpetuate their ignorance of the facts. The 81-year-old woman sued because she got third degree burns through her sweat pants on her groin, thighs and buttocks that required skin grafts, over a week in the hospital, and treatment for two years, and McD's refused to compensate her medical bills. There had been over 700 incidents of scalding coffee burns over the previous decade at that point settled by the Corporation, so this wasn't an isolated incident. Twelve jurors who were presented the facts sided with the woman, and McD's paid an undisclosed amount rumored to be close to $600,000 and lowered the temperature of their coffee.

    Just to bring this up...while I don't always pay the closest attention to movie credits, I don't think I've ever caught anything in them that credits every single designer of every single outfit in the movie.

    Seems to me this is a lot of so called 'controversy' over nothing.

    And your wrong to think the film makers won't make a penny from this, because if David Gordon Green is claiming it as his own design then he'll sell companies like Hot Topic the licensing rights to reproduce the t-shirt. So, yes they will make money from this. And what is a small independent company like WOWCH going to do? Fork out a large sum of cash to ake them to court? Not a hope in hell!
