You know it’s a seriously slow news week when a vague threat from the producers of a film no one saw earns more than one line of traction. Movieline got a press release last night from reps for Fathom Studios, which produced the barely-seen animated film Delgo. The Na’vi aliens in Avatar have earned some unkind comparisons to Delgo’s folk, and evidently all the jokes (they were jokes!) got the studio to thinking about their legal possibilities. Choice quotes after the break.

The release says:

From what we have seen, we are amazed by the visual similarities between the two films and we are reviewing what legal options may be available to us. Delgo is an independent film that took over a decade from conception to release. The initial proof-of-concept was available on Delgo.com in 1998 with work-in-progress from the feature production accessible via the website’s Digital Dailies since 2000. According to The Hollywood Reporter, Avatar began production in 2006 after a rewrite of the script.

OK, that’s probably enough of that. While it would be fun to see how this actually plays out, one has to expect that this is nothing more than a way to keep Delgo in the press for another minute. And look, because it’s a funny joke, it’s working! Good thing there’s no big superhero movie news this week. (Also: good thing the Na’vi can’t teleport, or Marvel would be in on this, too.)

And, as Movieline points out, Fox, the distributor for Avatar, is also distributing Delgo on DVD. Can’t imagine they’re too upset to have all of these Delgo references flying around in the press over the last week (More free press for everyone!). More people have probably seen Delgo since the Avatar trailer debuted than saw it in the months prior. I’m still not one of them, however, and don’t expect to be. I could barely even stomach the trailer, so I haven’t thought much about any possible Avatar connection. I know some of you already have in comments on other pieces, and feel free to continue the unkind comparisons below.

    The only comparison I can see is that they both are in the shape of a humanoid....in which case /ghasp let's sue 6 billion human beings for stealing our character design and using it on their own bodies!
  • There are actually some similarities in the Delgo movie that appear in the Avatar trailer. (I remember seeing quite a few in a post on UnrealityMag, if you care to go look)

    The problem is that James Cameron has been developing Avatar for the last decade and I can guarantee most of the scenes in this film were story boarded (that's a weird way to say it, I hope you get what I mean) LONG before any picture of Delgo was ever released.

    And seriously, pay them $50k to go away. That will double their DVD sales, I bet. They only made like $500k at the box office during a freaking wide release as it is.

    Having read the original treatment to Avatar YEARS AGO which graphically describe the designs for the creatures in Cameron's head it is painfully obvious that the 'creators' of Delgo did the same. I'm assuming the only reason for Cameron not to have sued them earlier was that this film is such a waste of breathe it wasn't even on his radar.

    Delgo, go #$%^ yourself in the #$% until you start feeding on the #$^$ you tried injecting into the land of pop culture.

    it probably took 2 - 3 years to create, and the rest of the time was spent trying to find someone to distribute the ugly thing!

    I actually saw this movie about 5 years ago when they were looking for a north american distributor. the company i was working for was not interested (of course). they asked us for our feedback, but the only thing i felt was that it shouldn't have been made in the first place. such a waste of time and money!

    We can debate the character designs all we want, but this is still just the plot of Ferngully with more guns. But then, no one seems at all concerned with whether or not this will be a good movie, just whether or not it will be a pretty one.

  • Comparing the two on a tech level is silly. One is full CGI giving them free reign to be as "cartoony" (although I HATE when people refer to them as cartoons) as they want to be while Avatar is blending real and fantasy. However, there definitely is some parallels that can be drawn and you can look at these pictures and see that it might just be more than the characters that look alike. Particularly the image of them flying.

    Oh, wow just another reason to not watch Delgo. I really am getting sick of all the Delgo Avatar comparisons. Delgo is just desperate to get some kind of viewership which I think is the lowest form of advertisement. The script for James Cameron's Avatar was written during the shooting of Titanic and it contains really in depth detail of how everything looked...so good job Delgo reading the Avatar script and then copying it.

  • I still think that the Na’vi aliens are fugly. They look like a cross between a Roe Deer and a human. Just look at the fantastic aliens you find in Mass Effect for example. They are freaking awesome!

    The floating rocks and riding reptilians are kind of similar i, but the character designs of Delgo and the Na'vi are really nothing alike.

    And you know floating rocks and riding reptilian monsters are nothing new, neither Delgo nor Avatar invented the idea. The prospect of legal action on vague comparisons (especially artistic comparisons) is completely ludicrous.

    Maybe whoever concepted fairies with insect wings should sue Delgo. and maybe the first person to concept a mech should sue Avatar.

    Yeah, there really isn't any actual comparison. I complained because of the surprising lack of perception in both instances, in creating such unappealing looking creatures, and expecting a large audience to invest in these horrid looking things. The Avatar camp has alot more going for it in terms of budget and concept, and it's creator, so that should help them do better in theaters.

    I wasn´t a big fan of the avatars look, but this delgo is the ugliest shit ever. I don´t like how internet sites, joblo amongst other have compared delgo with avatar. I didn´t even bother to read the article or read about what the company that made delgo is claiming from the makers of avatar. Only thing i want to tell them is that JC wrote his script over 10 years ago and had all the themes he has in the finished movie. If someone ripped off someone, it was the producers of delgo ripping of avatar.
