It’s a red letter day for Superman, pun intended. Not only is there some discussion about his potential appearance in the Green Lantern film, a crucially important law suit has been settled. Variety have reported that Warner Bros. and DC have been granted a favorable ruling in their case with the heirs of Jerry Siegel. This suit was first filed on April 16, 1999 so the decision has been a long time coming, and it is only an interim decision too, with more to come on other matters.

To cut this story down to the bits and pieces that really impact upon /Film business, I’ll quote the key lines from the Variety report after the break.

Here’s the first juicy nugget:

The judge, who conducted a 10-day bench trial, also noted that Warner Bros. chairman Alan Horn had testified that he hopes to make another “Superman” movie but added that the property wasn’t under development at the studio, that no script had been written and that the earliest another “Superman” pic could be released would be in 2012.

And the second:

[Siegel's attorney] Toberoff also asserted in a written statement that the Siegel heirs and the heirs of co-creator Joe Shuster will own the entire Superman copyright in 2013.

Which means, in effect, no more Superman comics from DC or Superman films from Warner Bros. after that date, unless the heirs of Siegel and Shuster strike a new deal. Mind boggingly, this could even see Superman travel over to become part of the Marvel universe. Wow.

So, any new Superman film would have to be in production relatively quickly, though nothing is actually on the cards. Perhaps there’s not even time for a full-on Supes feature, so our only hope of seeing Kal-El astride the multiplexes in new adventure might be a his rumored appearance in Green Lantern - though that, apparently, would be in his alter-ego guise of Clark Kent.

In an interview with MTV, Marc Guggenheim commented on the possibility:

Honestly, it changes on a daily basis. Whatever information I gave you today would be obsolete in a week, and maybe come back again in two weeks. And even if it wasn’t in flux at the script stage, it would still be constantly in flux because you can film it, put it in the original cut, and eventually it could end up on the editing room floor.

If I were Alan Horn I’d get Michael Dougherty, Dan Harris and Bryan Singer in my office first thing in the morning and start winding their keys.

    I dont understand why everyone dives in and bashes superman returns
    to bits. Remember there was nothing before it for many a decade, as its
    clearly one of the most daunting tasks out there to bring back. Some people
    simply refused to accept anyone in the role other than christopher reeve, which shows what the character means for many. Brian singer brought him back, and he is trying to fit in. You can ttack the man for what you call a bad film, but it clearly takes balls to dare to bring him back, with all this passion and rage about something not being how you like it. Now i was dissapointed with returns, like i was the phantom menace, but it has grown on me a little. And has the potential to be the starting point for something great. Its out there, and brandon routh is the role. He and everyone has had the weight of bringing superman back into our lives, and it makes us touchy, because hes not a sinner, like us, so we get angry and throw abuse. We should commend what was done on the last film, give CONSTRUCTIVE feedback, and be supportive and geared towards creating good karma for a possible sequel. The sqabbling will get us knowhere. We cant make the film, its not our job, lets support and campaign for a re-return, and to find out more about singers superman world. We want him in our lives, to remind us of what we really want to be, not what we are right now.

    The point is, even if DC Comics lose Superman rights, they still own Superman trademarks. Suppose that Siegels and Shusters don't want DC to exploit the character, nobody can.

    Or more exactly, DC comics could go on publishing Superman, just not Clark Kent from another planet, but could mantain the name and more important, any character or detail written after Action Comics #1. On the other side, for example, Marvel could start publishing his own Superman material, but couldn't name it Superman and couldn't use any character or detail writen after Action Comics #1.

    At least, this is what I understood from Comic Book Resources and Newsarama.

    You've got your facts all wrong. The lawsuit hasn't been settled — it goes to trial in December. The Siegels have already won a share of the copyright to Superman, what remains is figuring out how much of the character they own and how much money DC will have to pay them. DC will still own part of the character, so moving to Marvel is a complete fantasy, as is this preposterous notion that all Superman comics/movies/merchandise will end in 2013.

    Get Routh back, put him in Green Lantern and make the next Batman movie versus Superman.....

    Batman vs Superman is a terrible idea. If the story is written naturally, Superman's least sigh could blow Batman's head off. End of one minute fight, and end of movie. To make Batman win, the writer has to drastically de-power and dumb down Superman and turn Batman into a supernatural all-knowing god. Which just insults all the Superman fans and removes Batman's relatable human qualities. Movie audiences love Batman because he is the "normal human" superhero, not another supernatural dc god. And the contrivances to make both win or lose the fight will make everyone roll their eyes at the stupidity of such a chain of events.

    if you haven't noticed... Superman's "powers" range dramitically depending on the situation/writer/etc. In some comics, he can destroy a planet by sneezing... while on others he can get bunched into a building by Batman. Same with his speeed. Sometimes he's as fast as the flash and other times it takes him a few minutes to get across a city. That's why I don't really like Superman.

    Bah. You're obviously not a comics reader, or you wold know that Marvel can't hold a candle to DC. Marvel's stated audience are boys between 12 and 16 (Everything that goes BOOM is "coo-al"), while DC in fact goes for a bit more mature audience. AND they're getting it.

    I don't know if you read comic books or not, but DC is making the better books right now.
    DC has:
    7 amazing Batman titles. Green Lantern. Blackest Night is about to start. Superman World of New Krypton. The Flash.
    Marvel has:
    Captain "Bucky Cap" America. Amazing Spider-Man is ok right now. Dark Avengers isn't that good. Dark Avengers/X-Men Utopia is very promising.

    DC is putting out the best books right now between the two comic giants.
  • I don't get it. Why would Siegel and Shuster get the rights to Superman? Wasn't it the property of DC Comics, and thus Warner Bros? Why is this now being changed? What legal leg do they have to stand on?

    As I understand it, a long long time ago they sold the rights for Superman to their comics company for uh... what was it, 130 dollars or something? Something like that, right? And now they're going back to court and somehow saying that they want the rights back? What're they, Indian givers? Who does something like that? I mean, was it wise of em to only sell the rights for 130 dollars? No, probably not. Probably a bit on the low end, sure. But they were grown men and decided to sell em. And they were paid 130 dollars or whatever the amount was.

    So I really uh, really don't understand why they're now getting the rights again. It's very odd.

    Plain old fashioned greed, looks like. It was $130. I mean, it sucks for them for sure, but it is like any other business deal. What is done is done. To me, they got lucky. Warner also gave them pensions of $20,000 a year plus health care benefits for no reason other than sympathy. Starting in 1975 and going until their deaths.

    Unless Marvel can outbid DC for the rights... they are doing pretty well right now. They may give them a run for their money by 2013.

    I used to think marvel was infinitely better than DC, now I don't really think that, but I still prefer them. I think it might be cool to see a marvel Superman. Guess we will see.

    I agree. They signed their deals in the 1930's, and although DC aren't exactly blameless in every shady thing that's happened over the years later on (for instance, in the creation of Superboy), they did nothing but follow the standard procedure during those days. In other words, Siegel and Shuster DID willingly sell the rights to the character to National Periodical Publication

    Holy hell yes. When I read his idea months ago I had chills. A three film Superman epic from the day he is born to the day he watches Earth destroyed by a supernova. Amazing.
  • I realize this isn't great news for DC or WB but maybe they'll get another Superman movie out before the contract is up. I really hope they do and this also means that a reboot isn't possible. It is but it would take forever and the possibility of hold ups, they just can't take that chance.

    I think this would be amazing. They would sell so many comic books if this were to happen. I mean it would be so cool to have Superman teaming up with anyone from Marvel and having a great story.

    Dont just slap together random people who like comic books that is dumb, just say we are making this and tell us what you feel it should be like and go with the best one! And make it by popular vote or something Im so tired of seeing one man's vision of a character that has been written for by hundreds of writers! it took all of thier combined talents to make him the awesome character he is today and the whole rights thing is just sad, I like the idea of marvel supes but I doubt dc will let him go they will pay out their butts and make him any way the heirs want just to keep him. While I think it would be interesting what would happen to superboy (newly revived) supergirl and powergirl? There are too many characters based off superman to just move him, like how many of his villains are created by the creators? I doubt more then half and expect much less, and how do you make the transition it just would be awkward! Do you keep his history and have him just be misplaced in another dimension? Does metropolis just appear in the marvel universe? It would just be odd except that captain marvel would have to step up and I would love to see him be the superman for dc instead of the played out supes and screw freddy bring billy batson back and booyah new big 3 is cap, bats and ww it would be wonderful lol, plus being able to pit supes against hulk and thor on a regular basis would be crap your pants awesome

    You're right. For a long time, and maybe even still, DC would build up other heroes by having them tear down Superman. They made other heroes and villains look strong by beating Superman's ass. They made the heroes look noble by making Superman an asshole. They made the other heroes look smart by making Superman an idiot. DC came close to completely destroying Superman's character. Maybe Marvel would appreciate him more and know how to use him.

    there's no way WB/DC would let the Superman license get away from them. it was also ruled(i read from newsarama) that the judge ruled the creators don't get anymore money. but yeah, there's just no way.

    I don't know if Michael Dougherty, Dan Harris and Bryan Singer are the guys I would want in my office in the morning. Bryan's gigantic ego turned out the last one, which was a fluff fest that helped keep fans away from the film. It should have been doing Batman business. This thing definitely needs life breathed into it and quick. Look to people that have actual passion about the project ( didn't Mark Millar puff himself up as the savior of the franchise last year). Bottom line, Superman needs to step back on the screen and hand a ton of alien villains their asses, Lex Luthor has had his day, bring on Metallo, Braniac, Bizarro, Darkseid, Doomsday, General Zod. The Modern Superman needs to blow our asses out of our seats.

    I'm with you. It sounded like Millar had that amazing trilogy all worked out with the end being Superman as the last living being on earth. I say they get to work on that right away and shoot them back to back like LOTR. If Superman's gonna leave WB, they may as well make the definitive Superman trilogy as a swan song.

    Due to the time constraints and budget issue, I bet we get a Smallville based movie. Warner's won't start from scratch and has already let everybody's contract expire from SR. Alan Horn himself dissed Superman Returns in the court testimony. He said he had all kinds of issues with the movie including reviews worse than BB.

    I'd welcome it, but seriously doubt we'll see Welling on the big screen. I want Routh to return for the record. whether people want to admit it or not, superman Returns is one of the best superhero films ever made. Any sequel or requel or whatever similar to the incredible hulk would be piano in the face to such a fine film. Really internet you'd think the movie had Richard Pryor in it for no reason, the way people talk about it...

    Alan Horn is Warner Bros' president and ceo. He publicly tore down the Superman Returns movie in court. There will be no sequel, requel or anything to that movie. I sympathize with you. Everybody rips up the Matrix sequels, which I don't think deserves that kind of hate. But the Matrix franchise is dead, as is SR now. I've grieved and learned to accept it. I hate it, but if I don't want to become bitter, I have to move on.
