I know this will come as a shock to most of you, but when the 2008 Oscar nominations were announced the other day, a lot of people were upset that The Dark Knight got snubbed for Best Picture (and that Nolan got passed over for Best Director). Imagine that: Internet people getting upset that The Dark Knight is somehow not getting enough recognition. It’s wild, right?

All of the uproar led one Academy Award voter to state, “I plan on casting a write-in vote for [The Dark Knight] on the final ballot.” This raises the question: Could The Dark Knight win best picture as a write-in candidate? Hit the jump for the answer.

One of the factors that prompted the creation of write-ins was the 1935 snubbing of actress Bette Davis for what many considered to be one of the best performances of the year in John Cromwell’s Of Human Bondage. Outraged at this development, celebrities demanded the ability to write-in votes for Davis. Even The Hollywood Reporter got into the act, insinuating that the voting process that year was somehow mishandled. In response, in February 1935, Academy president Howard Estabrook announced that voters could write-in their personal choices for the winner of each category. Write-in votes would then be counted, just like any other votes.

At the 1936 Oscar ceremony, Hal Mohr became the first person in history to win an Oscar based on write-in votes alone. Mohr won an Oscar for cinematography for his work in the 1935 film, A Midsummer Night’s Dream (he had not been nominated). But due to the myriad of issues that were generated by the write-in process, not to mention the general confusion for all parties, the Academy changed the rules to forbid write-ins after 1936. This made Hal Mohr the first and last person ever to win an Oscar through a write-in campaign.

In other words: Sorry guys. There is no way The Dark Knight will be taking home a Best Picture or a Best Director trophy come February 22nd. But look on the bright side - at least it was nominated for a ton of other technical awards!

  • This. Right here. In my mind, it was my "Best Picture", and I saw Button and The Wrestler. I don't expect the Academy and myself to agree 100%, but the fact that they didn't even recognize it is upsetting. However, I can understand the reasoning behind why they didn't nominate TDK (although I may not agree with it). I do NOT understand how they could not nominate Chris Nolan as Best Director with what he did with IMAX and all. I guess you HAVE to secure a Best Picture nomination to be considered for Best Director.

    I don't think TDK was snubbed in any way. There isn't really anything overly great about it. So what if Nolan used IMAX in a new way If you watch the film it still looks like any other movie for the most part. There isn't a huge difference. If no one was told that Nolan used IMAX people would just watch the movie and not think anything special.

    On top of that Heath Ledger is the only true "wow" factor of that movie. I feel that to be nominated for Best Picture it has to achieve greatness in all/most aspects especially writing, directing, and acting. And not only by one actor. I feel that the technical nominations are sufficient recognition for this film.

    You know what film DID get snubbed for best picture? The Wrestler. Darren Aronofsky bot snubbed too.
  • @ TheDaftPunk - There are some cases in which directors can get nominated for Best Director while their films are not. Case in point: Julian Schnabel for The Diving Bell and the Butterfly.

    @ Dug - I do partially agree that Heath was the one "wow" factor, but the IMAX use is somewhat innovative and was awesome to see. The movie definitely showed some of it's flaws once I saw it for the third time on DVD; it's like an ecstasy rush. It just skyrockets you past all flaws to keep you entertained. In retrospective, I'd say The Dark Knight really DIDN'T deserve a Best Picture nomination. The Wrestler, on the other hand, should replace the nominations for The Reader. Seriously?

    I agree. For me The Dark Knight is the best movie of the year, and I already see all the movies that are nominated, and none come close to what is Knight. I'm sad too for Wall-E doesn't get the recognition it deserves, because it surpass 3 of the nominates for Best Picture in my opinion.

    Chris Nolan should not get a Best Director nomination because of IMAX due to the fact that the IMAX developments have already been nominated under Cinematography. For this, TDK and Benjamin Button can duke it out, both were beautiful movies.
    The Academy still messed up by not nominating Gran Torino for anything, not nominating The Wrestler for Best Picture or Director and for not nominating what should have been an easy winner in Woody Allen for Best Original Script for Vicky Christina Barcelona

    Thanks for getting my hopes up only to crush them at the end of the article. Why even write that heading? This is just the history of write in votes that ended in the 1930's, it doesn't seem to have a whole lot to do with TDK except for one random voter saying he's going to make a futile attempt to write in a vote for it. The academy crushed my hopes only a few days ago, only to have them piqued momentarily and then subsequently crushed again by you. Thanks.
  • I think what you can gain from the article is that the exception has been made before and could again. They've changed their rules and then changed them again. This kind of consistency lends to the ability to be somewhat optimistic that it can be done again.

  • I can't say I'm a promoter of the Academy, MPAA and things of that nature. Supporting actor, director and effects I can see. But here's my question best picture wise: Is everyone bent out of shape because it's that good of a picture or because a superhero movie of this caliber has been so long awaited?
  • TDK is not that good of a picture. I agree that it is a superhero movie that finally steps outside of the genre of superhero film. It became much more than that, but it is STILL not Best Picture nomination worthy. 5 excellent films were nominated, the only one I thought wasn't great was Benjamin Button, but I even think that The Wrestler should have snuck in for that spot.
  • I don't think it can win. Yes it was great and enjoyable, but there were some acting issues and editing issues. Yes Heath was great, and I really enjoyed the movie, but I wouldn't put it in the running on my list.

  • Nope, I didn't forget those, saw both in the theater a month and a half ago and liked them both. Both were engaging dramas, I was highly surprised on how entertaining Frost/Nixon was.

    Frost/Nixon was mildly entertaining but it completely lacked anything new or original as a cinematic experience. I'm sure it was a great play. The Reader on the other hand is a boring, navel-gazing, whiny excuse for a movie. Poor Kate Winslett if only she knew how to read maybe she wouldn't have been a Nazi prison guard. For my money replace these two with The Wrestler and Revolutionary Road and if you still want to get rid of Benjamin Button then slip in TDK.

    Best Directors Gus Van Sant, Danny Boyle, Darren Aronofsky, Clint Eastwood, and Christopher Nolan for getting that performance out of Heath Ledger.

    Look Aronofsky is my favorite working director but he wasn't nominatable for it. His style in that film was very very minimalist and a few subtle shots were forced. Though he should have been nominated for requiem though.

    Well if you started putting your choices, let me enter this too. My five for Best Picture would been The Dark Knight, The Wrestler, Doubt, Slumdog Millionare and Wall-E.

    For director: Christopher Nolan, Ron Howard, Darren Aronofsky, David Fincher and Danny Boyle.

  • indeed it is...it feels like a secret... like i know something and they don't...i don't care about their opinion and i know they don't care about mine...and i don't care if i'm right either...i don't need oscar verification to like the movie...it's a shame though for nolan...although i think he doesn't give a sh...t about it...cause if he wanted to win an oscar he wouldn't direct a batman movie...that would be just dumb...so all you tdk fans give it a rest...you should't care!

Many of us have been avid Batman fans our entire lives and back in the nineties if somebody had said that in the future a Batman movie could get nominated for a Best Picture Oscar that person would have been laughed at. So, in a way, TDK did overcome adversity, much like a bi-racial president.
    I'm talking about the people who stuck with Batman even while Schumaker sported him with pointy nipple armor and made him fight Arnie while he spouted one liners about ice. For some of those people TDK is more important than politics.
  • As much as I loved TDK (saw at midnight on release, bought the blu-ray on release) I'm really not surprised. I've seen 3/5 of the BP noms and have head great things about MIlk & The Reader, so TDK not being nominated didn't really shock me. It's a wonderful movie with a great story with one of the best characters ever created and Heath's performance was nothing short of spectacular. Applause all around to Nolan, the cast and crew, but it would have been a far stretch for TDK to even be nominated, let alone win BP.

    No, the movie is a symphony of car crashes. No more than that. It has nothing to do with what happens between people and it didn't hold my interest. I watched it in its entirety hoping for a human moment between somebody and somebody, or better yet someone to give a damn about. But no dice. It's a cartoon, for chrissake. Heath Ledger was fine in the role, but Nicholson gets the edge for giving the Joker a sense of humor.
  • The Dark Knight should have been nominated at least to give a nod to the film. And Nolan definitely should have been nominated for director, hell he probably should have won too. It's very sad that the Academy falls for Oscar-bait like The Reader.
