Marina Zenovich’s documentary, Roman Polanski: Wanted and Desired was probably one of the best documentaries of 2008 that you didn’t see. Zenovich meticulously documents the events surrounding the trial of director Roman Polanski, who unlawfully had sex with 13-year old Samantha Geimer, and the ensuing media spectacle. While the film doesn’t shy away from Polanski’s dark past, its primary target is the American judicial system, not necessarily the man himself. After watching, you can’t help but feel that despite Polanski’s crimes, justice was not served in an appropriate manner.

Apparently, Polanski, who is still technically a U.S. fugitive, felt the same way. As reported by The New York Times, Polanski asked the Los Angeles County Superior Court in December 2008 to drop the case against him due to the judicial and prosecutorial misconduct depicted in Wanted and Desired. Yesterday, prosecutors responded by saying Polanski should surrender to the court for sentencing before they can deal with these matters. If I had to guess, I’d say Polanski is probably not going to take them up on their offer. But who knows? Maybe after three decades, the director (now 75 years old) is finally ready to roll the dice with the U.S. justice system again and try to put this all behind him.

Regardless of his fugitive status, Polanski has continued to make critically acclaimed movies, such as The Pianist, for which he won the Academy Award for Best Director. Polanski is currently set to direct The Ghost, an adaptation of the political thriller by Robert Harris. Most recently, American viewers probably recognized him for his bizarre cameo as a policeman in Brett Ratner’s Rush Hour 3 (Was I the only one that thought that role was a huge WTF?).

  • it doesn't really bother me that the justice system might have been fudged here. the guy is a child molester and he deserves to burn, instead of being aloud to scurry away like the rat that he is. i suppose that an unofficial "ban" from our country is good enough for now though.

  • HEAR, HEAR!!!!!
  • Agreed. We wouldn't excuse Jeffrey Dahmer if he was a genius at modern interpretive dance.
  • Dr. Doc
justice wasnt served in an appropriate manner? HE HAD SEX W/ A 13 YR OLD GIRL!!!

what would be your definition of justice? just because he is famous and alot of time has passed doesnt mean that this fugitive should be let off the hook! he is a criminal! there is no getting around it
  • He's a fucking piece of shit. Filthy rapist, I hope he burns in hell!!!!
  • sammysam
its pointless to be vulgar, but i happen to agree with these people. rape is rape no matter how the case was handled.
  • To us he's just a freak.

    I could'nt help it.
  • He might not be in our country, but he is still making money from the people here. Just like the director of "Jeepers Creepers."
  • Holy shit. I had no idea it was the same guy who made Powder.

"Victor Ronald Salva (born March 29, 1958) is an American film director, mostly of horror movies. His body of work includes the films Powder and Jeepers Creepers. His work is often overshadowed by his conviction for sexually molesting a 12-year-old child actor Nathan Forrest Winters. Salva pleaded guilty in 1988 to five felony counts of child sex abuse; he served 15 months of a three-year prison sentence."
  • When "Jeepers Creepers," came out, and the a***ole was getting all these praises, the boy he raped came out and made a statement against him. It was so horrific to read this guy's letter. A lot of people still don't know about him or Polanski.
  • Ummm....Whatever happened to "Innocent until proven guilty?"

The charges against the man are horrendous, and if they are true, then lock him up! Living abroad isn't helping the situation either, and if he was a real man he'd, well, man up and face the charges held against him. My opinion....

Continue with the lynch mob comments.......
  • haha nice

But as i recall in other countries people get married and have sex at 10. So who are we "Amerikkkans" to say what age you can start having sex. O if a guy is 20 and a girl 16 or 17 everybody freaks the fuck out. But if its a girl 25 and a guy 45 no one says anything? Come on man. She probably wanted it. But hey, none of us was there so no one knows the true story except her and him. But if it was my daughter i would have blown his head off with my shotgun!!!

    My 2 cents
  • Dude, you are extremely ignorant if you think that anyone pre-pubescent or in puberty is in any way shape or form mature enough to understand and handle sex. The argument of a 25 year old with a 45 year old is NOT the same as a 13 year old and a 45 year old. You are even more ignorant for justifying the argument. You are hypocritical and karma should kick your ass so you can understand what that 13 year old's parents had to endure during that time, let alone the child herself. Forceable sex in any form is a horrible crime and is definitely punishable.
  • you should have heard Sheila Nevin's comment. She's the president of HBO Documentaries and she said that Roman should be "excused" because he's a great artist. My mouth dropped open when she said that.
  • I guess she probably believes OJ's in the clear too for his football and film legacy.
  • As would mine. 12 people in a jury would definitely take offense to that
  • i was just about to mention that guy too! he did serve time in jail at least. i don't know if anyone suffered through "Jeepers Creepers 2" but if there wasn't some mild pedophiliac content in that movie than i'll be a monkeys uncle.

also, the director Larry Clark has put some semi-questionable material in his films and used the "nudity is art" argument.

what a sad, sad world we live in.
  • Rob
You know what happened to "Innocent until proven guilty" it is being upheld in this case. Polanski pleaded guilty to having sex with a minor. The guy fled the country after he pleaded guilty and before the judge could hand down his sentence.
  • he fled the country, that makes it sort of hard to prove him guilty or innocent. also, running away like a coward is a pretty strong admission of guilt, don't you think?
  • He really needs to face the charges. This will always taint his career.
  • Rob
I do think Polanski got a raw deal from the judge, but he is an admitted pedophile who after he fled the country started to date a 15 year old Natassia Kinski. He pled guilty to having sex with a minor. His victim claims he drugged and sodomized her.

He paid for his crimes by serving a few weeks in jail for observations and living a "hard" life in a villa in Fance, dating and marrying models, directing films with the likes of Harrison Ford, Johnny Depp, and Adrien Brody, acting opposite Jackie Chan, winning an Oscar (where non-rapist Martin Scorsese can't seem to do), and being the toast of France.

If Polanski wants to come back to America, let him face the music like anyone else would. Just because he is a very talented director and calls stars like Jack Nicholson friend shouldn't get him special treatment.
  • If he pled guilty then send Dog the Bounty Hunter to get him, I say. Didn't he get another deviant one time?
  • In another country? Hahahah....Can you imagine Dog in Europe?
  • He went to Mexico for that one rapist dude. That capture made him famous. After that racist espisode and countless CNN embarassments, I think that Polanski would take him back to the top of Trash Bin TV again.
  • his reputation is already tainted. His career, not so much.
  • yep, that's celebrity justice for you!!!
  • I agree with everything you said. All my thoughts were addressed in my reply already. But Rob said that he had already pleaded guilty. In that case, he needs to be jailed.

Still, it doesn't matter if you run or not. The term "Innocent Until Proven Guilty" applies to any person wanted for questioning, or any suspect on the run. Running is NO ADMISSION of guilt. There are a million reasons why someone would run, and I agree that in most cases people that run usually might be proven guilty later. But the law is the law, and innocence is ALWAYS assumed in the court of law until proven otherwise.
  • Margot
I think the case and the man are more complex than any of us can imagine. even the victim has repeatedly said that she did not want for him to go to prison. And how can we all just ignore the trauma Polanski lived through when his wife Sharon Tate being 8 1/2 months pregnant was brutally murdered by the mason gang. That would mess with anyone's mind. He should pay restitution to the victim and everyone should move on. As to Natasha Kinski...I grew up in Europe and Polanski was not her first lover; the magazines there always had a field day with her sexual exploits as a young teenager.
  • Rob
First, your wife getting brutally murdered is not excuse to get a free pass to comit felonies yourself. Yes, Polanski had a lot of personal tragedies, but plenty people have as many or more and do not sleep with children. It is BS excuse for Polanski apologists.

Also, the she isn't a virgin defense is just as BS. The statutory rape laws in this country do not say that once a minor has sex, he/she has the power to give consent to sex to adults. Just because Kinski was promiscuous doesn't change the fact that a man in his 40s had sex with a child.

For example, my niece's former best friend is a 14 year old ho-bag. If I, as an adult, had sex with her even though I would probably be her dozenth sexual partner, I seriously doubt the police will refuse to procecute on that information.
  • it works for Catholic priests!

Im not ignorant at all. Im stating fact. Once again, you fail to notice that the victim in question wasn't 13, she was 15 according to her own statements. In this documentary, she states her age at 46, therefore she was born 1962. Also note how many times the victim has changed her story according to whatever fame she seeks from it. At first she says she's a victim. Next she says post-civil suit and massive payout, that Polanski didn't harm her, the system did. She supports Polanski now? Why? She's getting the fame she and her mother sought back then. It's okay now, it can "Go away," according to her own words because she's gotten what she wanted.

So let's re-examine the issue of Statutory Rape. First of all, no where in the indictment which Polanski pled guilty to, was the word 'rape' used. The official charge was ONE COUNT OF UNLAWFUL SEX WITH A MINOR...hence, no rape. This charge both the 'victim' and her family agreed to. Which means, the only thing that took place that afternoon was that two people had consensual sex. The only law that was broken was that of her age, not whether she could or couldn't consent, which the 'victim' has now said it was. She herself has stated it was consensual and a 15-year-old can consent. And given that I am one year younger than said 'victim', I can tell you in my generation, which this is, we did consent. A 15-year-old can consent despite your obvious lack of the factss facunderstanding of the facts in this case.
  • Rob
Just because a person pleads guilt to a lesser crime doesn't mean that he/she weren't guilty of a more serious crime. Polanski pled guilty of statutory rape (unlawful sex with a minor is the term for statutory rape in California). Doesn't mean that he wasn't guilty of rape. It means that that was a compromise his attorneys made with the DA to save it from going to trial. Samantha Geimer's attorney tried to broker a compromise because she wanted the ordeal to be over. She has always claimed that the sex was not consentual, but has decided to not pursue it anymore.

Also, the age of consent in California is 18, not 15. Geimer was 13 at the time of the offense. The documentary that was aired last year on HBO had been filmed several years earlier. That may be where your mistake is. Go do an internet search and you will see every article on this will say she was 13.

Before you state facts, you might want to make sure they are correct facts. Here is an interview Geimer did in 2003 for CNN that shows you are wrong:

Have you forgotten that her mother was pimping her out and that she was a teenage prostitute?

So it's not black and white. The mother and the girl were on it together, as Samantha is the first to acknowledge. I am not defending Polanski, but she was no victim, either.

If he wanted sex with this girl, he could have probably just asked, rather drug her and rape her anally. Her mother had sent her to this party out of greed and stupidity - I don't know what the girls intentions were, but she certainly had the right to choose whether she wanted intercourse or not.

Polanski took that choice away from her and like all rapists, he needs councelling and accountability. not a personally delivered Oscar.
  • Rob
First, Samantha Geimer never said she and her mother were in on it together or that her mother was pimping her out as a prostitute. Where in the hell did you get that?!? Some of Polanski friends have accused the mother of being at fault because she supposably knew what type of man Polanski was and his love of underage girls.

Geimer has admitted to having sex and taking drugs before that encounter and has always claimed that the sex was not consentual. She has adamently denied her mother put her up to it any way. Please get the facts straight.
  • I love reading comments about crimes such as this on internet forums. Everyone wants blood. I find it amusing. But, before you start calling me names. I think he should come back to the US. I think he should have a fair trial. And I think he should serve his sentence if one is given. Simple.

You cannot let passion drive justice. That's when we start getting into eye for an eye. Unless you're into that sort of thing, if so. Please stay away from me.
  • jerry seinfeld
i agree, but you're ignorant of the situation. Polanski pled guilty to a lesser charge, and fled the country before a sentence was handed down. France won't extradite... So it is Polanski himself that has impeded the justice system in this case.
  • "Polanski took that choice away from her and like all rapists, he needs councelling and accountability. not a personally delivered Oscar." And on this I will agree. This chick may be f'd up and was under some sort of control as a minor, yet that still doesn't take away the fact that she was not mature enough to make the decision regardless. I suppose I was more arguing against your age justification, and to that I still say that a teen does not understand the gravity of the situation when it comes to sex.
  • REAL6
O no trust me i agree with you 100% But also from experience it depends on the person. Im a male and when i was 18 i had a girlfriend that was 13. But before you could say anything she didnt look it and already had a kid. You would have thought she was my age. I didnt know till months later her age. But she had been thru alot of trauma in her life where she grew up quick and had her own place. and went to school. so im just saying from a certain standpoint, depends on the situation. im 30 now and i think that shit is very nasty. But im trying to just give an exsample. he should have the book thrown at him for fleeing.
  • Yeesh, I seriously hope you double bagged that or got tested afterwards. Cause I mean... that's just... wow.
  • REAL6
Nah i was bagging. Im trying to live ;)

Can we retire the phrase "was probably one of the best [whatevers] that you didn’t see" from film criticism? It reeks of elitism - of a feeling that the masses don't have the capacity to seek out hard-to-find films. I love Slash, and this is far from the only place it occurs, but there it is. If I'm on a wonderful site like Slash, chances are if I want to see a film, I'm going to see it. Plus, this documentary was on HBO. It wasn't that hard to find it.
  • jrgreer
He drugged and raped a child and then fled the country. If he comes back, he should do time. End of story.
  • Polanski drugged a 13yr old girl so that she was nearly unconscious and then raped her. Imagine having a 13yr old daughter who is off with a 30-40yr old man and he has sex with her. Think about the maturity level of a 13yr old girl and the kind of man that would have sex with a girl that age.

Also, this wasn't the first report of Polanski seducing and having sex with underage girls.

Additionally, when questioned about this Polanski feigned that he wasn't used to the customs of the United States and thought it was appropriate behavior based on his culture and where we grew up. Ridiculous.

He's guilty. Period. He deserves jail time and it's disgusting that people excuse this behavior.
  • Since when is it illegal for a powerful director to bag a 13 year old?
  • I am a huge supporter of the 'you commit a crime, you do the time' philosophy, however at the same time, Polanski is still a fantastic director and I hope he continues to weave through the nuts and guts of cinema. The best of both worlds is that he returns to the US, is sentenced judicially and proceeds to 'do his time' before returning back behind the camera for a few last cinematic hurrahs!
  • He had sex with a 13 year old??? I didnt hear that... i should watch more news. Well it was statuatory (spelt rite?) rape... not regular rape.

Seriously his role in Rush Hour 3 was... :/
  • Scott
If you read the victims testimony from the trial, there was nothing statutory about it. He sodomized a 13 year old while she was saying "no, stop"
