Will Watchmen Be Delayed?

The latest Watchmen legal update comes via The New York Times:

“The report also outlined conflicting requests for a trial date: as early as next June, if Fox has its way, or April, if Warner prevails.”

A count injunction and a June start date could possibly delay the release of Watchmen until 2010. Even the April start date that Warner Bros is pushing for would probably delay the film’s release until Summer 2009 at earliest. And if Fox wins the court case, who knows if we’ll ever see the film at all (yeah, this is rather unlikely, but Fox’s official stance on the matter is to prevent the film from being released altogether).

I’m not a lawyer, so I won’t pretend to be one. All I know about this case is what I’ve read in various newspaper reports and from what I could understand from the court filing. Ad looking over all the publicly released claims has me worried. The fanboy attitude is to attack Fox, but it looks to me like Warner Bros might be at fault. It’s a shame that the studio didn’t try to work this out before the film went into production, before a trailer was released, and before millions of fans got excited. Hopefully we’ll be able to see Watchmen on the big screen sooner rather than later. I’m guessing (and hoping) that this suit might be settled out of court before March.

    I thought Fox said that they wouldn't try to stop the movie from being released...I think the court should be allowing the release then during the trial come to percentage Fox should get...this is an overreaction

    There's a very good chance that this will be settled out-of-court.

    Considering that it's Warner Brothers, who must have a crack legal team working for them, they probably looked into this issue and went ahead with the project, knowing that they could legally prevail if a case were ever to come to fruition. So quite possibly, Fox is just playing hard ball with Warner Bros. for the purpose of making a profit off of the film. The comment that they made ('we don't want the film being released altogether') could very well just be a bluff. And even if this were to go to trial, there's a lot of room for interpretation in regards to the clauses in the various contracts. So, all in all, this thing is up in the air, and Fox is probably playing their cards with the hopes of making a buck off of a production that they really didn't have to back.

    Its Unfortunate with all the tease behind Watchmen. The trailer, Kevin Smith, everything got me excited to watch it. I haven't heard of Watchmen till Slashfilm made the effort to talk about it. I'm reading the graphic novel and personally I think its a real stab at the fans for Fox to affect them with their licensing problems and Warner Brothers. I don't care if Warner Brothers was a real douche I want to see the movie. I think people can agree with me.

    Well considering the half billion for Dark Knight, not including DVD sales and such, yeah GET THE MONEY any way they can. This was a mistake on Warner from what I've read so the beast will get in where it can.

    That's sad. Hopefully the desire for such a thing won't dwindle

    you see, this is what makes me hate Fox. They aren't satisfied with getting paid even, instead they've moved on from canceling their own quality shows to other people's. They won't be happy until they can cancel everything that has any promise whatsoever from any studio or network.

    I say scrap this premature cash-in opportunity, get everything ironed out, and make Watchmen into a short, but ambitious cable series. I still dont see this working as a one-sitting feature film anyway.

    Personally, I can wait another several years until someone cares enough to make it more than a sequence of pretty images.

    is that from a new article? because a Fox spokesperson came out and said they wouldn't try to stop the release...it came out after all the talk of boycotting "Wolverine" and other Fox movies by fanboys and the comic book community...

    I do believe this will be settled out of court, you never know they could have made an agreement before production and this is all hype...so they can get more coverage on the release and people are curious about the comic check it out and learn...I have to admit before Zack was attached I had never heard of "Watchmen"...then again I'm not a huge comic person...look how many papers and blogs are covering this whole thing, it feels like a way of promoting without spending millions....

    You know, I'm in a tough position. When Fox first came out and said they wanted to keep this film from being released altogether, I had committed to boycotting Fox and all of its properties, no matter how much I wanted to watch them. Problem is, none of their upcoming movies look any good (Wolverine has just as much potential to suck as it does to rock) and their TV shows are mostly garbage reality shows, I never cared for 24, The Simpsons isn't any good anymore, and Family Guy...please. So with me committed to a boycott and Fox committed to releasing a constant wave of shit that I wouldn't bother watching anyway, who wins, me or Fox? Also, if Fox really is committed to crushing all the promising work Zack and company have done, I hope that they just stop his film and that be the end of it. Don't get me wrong, I haven't been this excited for a film since Star Wars Episode 1 (back when I still had faith in George Lucas) and Zack's interpretation looks legendary, but I'd rather never see a WATCHMEN movie than watch whatever Fox scrambles together be foisted on the public as a WATCHMEN movie. In short: Fox if you're going to kill this movie, don't go make your own version.

    I was sort of joking around, but still you never know..I understand it's illegal but if they agreed without papers and then Fox took it court...you couldn't really prove if they had agreed beforehand, hence not illegal

    depending on the studio nothing is beneath them, promotional-wise...WB sent a box to a press outlet, which they thought was a bomb..I don't remember if it was ticking but they assumed it was a threat..it ended up being a promotion for the Dark Knight...

    This is exacly like in Entourage...season 3 or 4 im not sure where they want to do a film but the head dude at Warner Bros. has the script and just out of pure hate for Vinny and Ari he locks it away in a drawer never to be produced.
    I think there should be a massive boycott on all upcoming Fox releases so that they stop being little money hungry turds and release the movie!

    Problem is, what upcoming Fox film besides Wolverine would any comic fanboy stoked to see WATCHMEN even bother to see in the first place? Marley and Me? Please. Fox's line up is shit and any fanboy boycott isn't going to convince them not to be the asshats they are. We all know that, ultimately, a fan launched boycott won't be that large. However, if you really want to make an impact on Fox, however small that impact is, boycott their television programs, where it will really hurt them. I know I said earlier that for me to boycott wouldn't be much a departure from the norm, given I don't really like any of Fox's shows with a few exceptions, but I am sure there plenty of WATCHMEN fans who watch 24, House, Terminator: The Sarah Conner Chronicles, and other Fox shows and to whom the boycotting of these shows would actually mean something as it would be depriving them of entertainment they actually enjoy. To do my part, I won't be seeing Wolverine (a movie I was planning on seeing) if this isn't settled by the time that comes out.

    Technically, I think its all WBs fault and I'm not going to babble all about why. Okay, let me make this short. Bascially the claim is that WB violate a 1994 agreement with FOX since they have the rights to develop, produce and distribute. WB failed to resolve this with FOX before production. Now us fans have to wait and its all WBs fault. I think in the long run, FOX is looking to share the profits or distribution rights.

    If it was a perfect world, Fox would pay Warner Brothers back a percentage of the production budget, and in return, receive that percentage of the gross.

    For example:
    Watchmen has a $100 million budget.

    If Fox paid Warner $30 million, they would get 30% of the final gross.

    I think it's fair, and would be good for Fox because it would be low cost, and big reward, since this film is gonna be huge.

    But this isn't a perfect world. So this will never happen.
